Do's and Don'ts

What Happens If You Give Up Your Right To Receive "No-Fault" (P.I.P.) Benefits From The Only Auto Insurance Company That Is Obligated To Pay Them

You may give up your right to receive "No-Fault" (P.I.P.) benefits from the auto insurance company that is obligated to pay them, but that will not result in you receiving "No-Fault" (P.I.P.) benefits from a different auto insurance company.  Instead, that results in a complete forfeiture of all "No-Fault" (P.I.P.) benefits altogether (so, if you do this, you will never receive most of your lost wages and you would have to pay most of your medical bills out of your own pocket).  Under the law, even the insurance company on the other side does not owe you the "No-Fault" (P.I.P.) benefits that you voluntarily give up this way (even though the other side was at-fault).  So, if you are to receive "No-Fault" (P.I.P.) benefits, you will receive them from the (one and only one) auto insurance company that is legally obligated to pay them, or you will not receive them at all.
