Do's and Don'ts

About The Deductible On "No-Fault" (P.I.P.) Auto Insurance (Usually $1,000.00)

Do not worry about the deductible on your "No-Fault" (P.I.P.) insurance. Contrary to what most clients believe, if you have a $1,000.00 deductible (the usual amount of that deductible) which applies to "No-Fault" (P.I.P.) auto insurance, that does not mean that you have to actually spend $1,000.00 out of your own pocket up-front.  As a practical matter, all this means is that neither you nor the "No-Fault" (P.I.P.) auto insurance company pays anything at all to anyone until after 80% of your medical bills get over $1,000.00.  After 80% of your medical bills get over $1,000.00, then only the "No-Fault" (P.I.P.) auto insurance company (not you) pays 80% of the remaining medical bills. Later, if you prove that your injuries qualify you for payment under a special law, then the other side owes you the full amount of your deductible (even if you did not pay that $1,000 to anyone yet), plus payment of the rest of your remaining unpaid medical bills, plus additional payment just for your qualifying injuries.  So, (if you were not at fault) when you receive your settlement money from any bodily injury liability insurance on the other side (or any uninsured motorist coverage that might be available), you can use some of the settlement money you receive to pay off all of your medical bills that were left unpaid because of any deductible and the co-payment (the co-payment is the 20% share left over after the "No-Fault" (P.I.P.) auto insurance company paid its 80% share). For this reason, you do not actually use your own money to pay medical bills. To protect you from having to pay any medical bills out of your own pocket or having credit problems, we refer our clients only to doctors that will agree to accept what "No-Fault" (P.I.P.) auto insurance companies pay them, and they will not demand any money from you until you receive settlement money from the other side (or until you drop your case, whichever comes first). Of course, this will not help you in connection with medical bills you already ran up before you hired us (like the hospital bill).  So, if you were not at fault and if you go to the doctors we refer our client's to, and if all of the right kind of insurance is available, then you will not have to pay any medical bills out of your own pocket (unless you drop your case).
