There are two basic ways legal costs (what other people charge the
client) are handled. One way (the traditional way) is that the client
pays the lawyer a "retainer" or "cost deposit" up front from which the
lawyer pays his client's expenses to others. In this way, the lawyer
never spends his own money for a client and, therefore, never asks his
client for a refund of what he spent. The other way (our way) is
exactly the opposite.
To make it easy on our clients, we do not ask the client for a
"retainer" or "a cost deposit" up front to pay expenses that others
charge our client. Instead, we advance the client money for their costs
(what other people charge the client) right out of our own pocket. So
when a case settles, we are "in the hole," sometimes several hundred
(in some cases, thousands of) dollars. The contract we have with our
clients allows us a refund of what we were forced to spend for our
clients out of our own pockets (so, we break even if we get our money
back). This means we do not "make money" off our clients by getting a
refund of what we already spent for our clients by not demanding that
they pay us a "retainer" or "cost deposit" up front, the way other
firms do.
