Except when talking to your own doctor, or when talking about towing, storage, repairs or the total loss (sale) of your vehicle, do not talk to anyone unless your lawyer is present or on a telephone conference call with you. Do not describe how the accident happened to any insurance company representative for any reason (no matter what), even if you do not understand how it would hurt your case. Contrary to what most clients believe, the insurance company representative does not want your description of the accident to make you eligible to receive their insurance company's money. Instead, the insurance company representative wants your description of the accident to destroy (or substantially reduce) whatever eligibility to receive their insurance company's money that you already had. So, you can not win your case by telling the insurance company representative the way the accident happened. But, you can lose your case by telling the insurance company representative the way the accident happened. But remember, talking about your vehicle, and describing the way the accident happened are not the same thing. You may talk to the insurance company representative about your vehicle, so long as you do not describe the way the accident happened or talk about your injuries. If you talk to an insurance company representative about the repairs or the total loss (sale) of your vehicle, discuss only the vehicle's location, cost or place of vehicle repairs, vehicle value (appraisal), vehicle towing, vehicle storage, or vehicle rental (do not describe how the accident happened or talk about your injuries, etc.). Only discuss vehicle (not accident or injury) matters. Immediately forward to us all insurance company inquiries, telephone messages and papers that you receive which are not about your vehicle claim.
