Limits On Lawsuits Oer 'Loss Of Value' Of Your Vehicle And How Those Limits Encourage Insurer Fraud.
The insurance company on the other side knows they are shielded by an
unfair law that prevents your lawyer from filing lawsuits against them
for any dispute about the "loss-in-value" of your vehicle (or other
vehicle disputes) unless that vehicle dispute is made a part of the same lawsuit that, if necessary, is filed later against the other side for injuries (and insurance companies know that you cannot sue the other side for injuries, much less get a jury decision on your "loss-of-value" claim, for years because of a different law that restricts, and effectively delays, lawsuits for injuries). Bettcher v. Wadsworth, 825 So.2d. 438 (Fla. 2nd DCA 2002) (citing McKibben v. Zamora, 358 So.2d. 866, 868 (Fla. 3rd DCA 1978)). Because you cannot sue the other side until your injury case is ready (usually at least
six months after the accident), the other side will probably refuse to
reimburse you for the "loss-of-value" of your vehicle (because they
know they cannot be held accountable for years, and then, if they are
caught for not paying you, then they only have to pay you what they
should have paid you in the first place, plus a little interest). Even
in cases where the other side honestly admits they owe you just for the
loss in value of your vehicle after repairs, they always dispute
the amount of that loss in value and then (claiming they are confused
over the exact amount they owe you) they refuse to pay anything at all
(even though they simultaneously admit they owe something, and not
nothing). If lawmakers would allow timely law suits against the other side just for your vehicle claim, the insurance companies on the other side would be forced to pay for the "loss-of-value" of a "repaired wreck" in virtually every single auto collision case. So, even though you have no legal way to timely force
the other side to reimburse you for the "loss-of-value" of your
"repaired wreck", we still recommend that you follow this instruction
and try to recover the "loss-in-value" of your vehicle anyway.
