A "lien" is a debt that attaches to your settlement money. A lien
provides the "lien holder" security for the payment of a debt you owe
to them. A lien legally prevents you from getting your settlement money
without "satisfying" (paying) valid liens against your settlement
money. "Liens" get attached to your settlement money by certain
hospitals which have not been paid and by some doctors (that want
payment of a bill). But, "liens" also get attached to your settlement
money by medical and worker's compensation insurance companies and
government agencies (that paid your medical bills or lost wages and
that want their money back). The "No-Fault" (P.I.P.) auto insurance
company that paid your medical bills or lost wages does NOT
have a lien against your settlement money. But, almost every other
insurance company and government agency that spent money on your
medical bills or lost wages does have a lien against your settlement
money. Your lawyer does not place liens of hospitals, insurance
companies or government agencies against your settlement money. So, do
not get mad at him or her about liens. Some lien holders are legally
entitled to get all of the money they are owed (or all of their money
back) out of your settlement money. Others are legally entitled to get
only part of the money they are owed out of your settlement money. No
matter what the lien holder's legal rights are, we always try to make
deals with them to save you money. All of the savings we generate in
this way go to you, not to us. The only way to avoid these types of
liens is to stay out of the hospital and refuse money from every
insurance company (except auto insurance companies) and governmental
agencies from which you are eligible for benefits. The only way to get
your settlement money is to "satisfy" (pay off) the liens. See
paragraph #59.
